BCG GARDENERS’ AGREEMENT

  • I will assume responsibility for maintaining my plot – including: weeding; organic gardening practices; planting crops that will not shade neighboring plots; and keep litter picked up.
  • I understand my assigned plot is available for use March through October and all crops must be harvested and the plot cleared by October 31st.
  • If I use fertilizers, nutrients, herbicides or pesticides they will be 100% organic.
  • If my plot becomes unkempt, I understand I will be given two (2) week’s notice to clean it up. After the two weeks, if the plot is not cleaned up, it will be re-assigned or tilled in.
  • I will not alter the dimensions of the plot or surrounding area.
  • I will not bring in or build any structure over 5’ tall in my garden.
  • I will sign at the Gardeners’ Bulletin Board each time I am at the garden.
  • If I must abandon my plot for any reason I will notify the garden leadership team.
  • I will participate in at least one (1) BCG “Work Day” in the garden each month (Wednesday evenings or Saturday mornings), helping maintain the common areas and neighbors’ garden.
  • I will pick only my own crops.
  • I understand that the property is only ‘open’ between sunrise to sunset and I will not be in the garden area outside of these times.
  • I agree to put all organic waste in the designated compost pile.
  • I agree to respect the peace and quiet of the surrounding neighborhood.
  • I agree to be civil and cooperative in regard to other gardeners, neighbors, and the public.
  • I will not bring pets to the garden.
  • Children are welcome at the community garden, but must be supervised at all times.
  • I understand that neither Benson Community Garden, Inc. nor owner of the land are responsible for my actions.
  • I ACKNOWLEDGE AND UNDERSTAND THAT I AM SOLELY RESPONSIBLE FOR ANY PROPERTY DAMAGE, ACCIDENT, INJURY OR LOSS SUSTAINED TO ANY PERSON WHILE AT THE BENSON COMMUNITY GARDEN, AND NEITHER BENSON COMMUNITY GARDEN, INC. NOR THE PROPERTY OWNER ACCEPTS LEGAL OR FINANCIAL RESPONSIBILITY. GARDENERS AND VOLUNTEERS ASSUME ALL RISK OF INJURY OR OTHER LOSS RESULTING AND WILL HOLD THE BENSON COMMUNITY GARDEN, INC. AND PROPERTY OWNER HARMLESS WITH RESPECT HERETO. I HEREBY AGREE TO INDEMNIFY AND HOLD BENSON COMMUNITY GARDEN, INC., VOLUNTEERS, SPONSORS, BOARD MEMBERS, OFFICERS AND/OR THE PROPERTY OWNER HARMLESS FROM ANY CLAIMS, INCLUDING THOSE OF THIRD PARTIES, ARISING OUT OF OR IN ANY WAY A RESULT OF MY USE OF THE PREMISES OR ITEMS THEREIN.
